I have an LCA that was approved for an amount that was very slightly higher than the prevailing wage. I worked for an employer for almost 2 years (~1.9 years). For the first full year, they have paid me a base + "discretionary bonus" salary as stated an offer letter that came after the LCA, that was equal to the LCA amount. The bonus is 25% of the base salary so the difference is quite a bit. But since I didn't complete the second year (0.9 of a year), and got laid off, the company is refusing to pay a portion of the bonus so that the pay rate is in accordance with the amount in the LCA. Is this legal and can I ask them to prorate the portion of the "discretionary bonus" because not getting that bonus amount puts my pay rate lower than the LCA wage as well as the prevailing wage?
