My H1b was approved in 2012 and I have travelled to US in 2012 with my previous employer. My petition validity is until 30/9/2014 and my visa expired in 2013. My previous employer has revoked my h1b in 2015. Now my new employer is trying to file a cap exempt. Will I be eligible for exempt. I have utilized for lesser than a year, the un-utilized period is 5.3years. pls. advise as my current employer has initiated Cap exempt request.
