My employer is asking to sign an agreement which says I need to pay around 10K$ to him if i leave him in 12months from the date(h1b approval date) due to liquidated damages from training costs, attorney fees. I had already been working for him before h1b got approved for 1.5 years but he puts a new agreement after h1b got approved and mentions this agreement supercedes all agreements signed. He mentioned a non-compete clause to prevent joining clients but my client hired me in contract to hire role after signing an agreement with myself and my employer while hiring me on contract. Is this agreement valid? My employer will give my original h1b i797A and LCA only after signing such an agreement i understand from what he spoke to me & not agrees to changes in agreement. Is this agreement legal or can it be used to sue me &win against me if i jump to client or leave him in 12 months?
