It is very common that most H1B, L1, F1, J1, M1 and their dependents may not have a valid visa stamping to travel abroad if you have changed your status or extended your non-immigrants status. US Customs and Border Protection has made a provision to validate an expired non-immigrant visa to be automatically extended to the date of entry to the United States. This provision is called “AUTOMATIC RE-VALIDATION OF VISAS “ Please note that each visa category has exceptions of countries that you may travel and return to the United States without a VALID VISA STAMPING ON YOUR PASSPORT. Apart from the exceptions and countries...

We all know that drinking and driving is not only dangerous, it’s a crime in the United States. One may get arrested while driving intoxicated with Alcohol or Drugs. In this Article, I would like to discuss about the consequences of Arrests and DUI/DWI charges to your H1B, F1 or Green Card Immigration status. “Please note that this article is also informational to every person in the United States who is a non-citizen.” What is DUI/DWI? DUI stands for Driving under Influence and DWI stands for Driving while Intoxicated with Alcohol, Drugs, etc. Driving while Intoxicated is a crime in the...

We had several queries from our supporters about H1B filing, lottery and tracking the returned H1B packages. How to ensure that the H1B was filed? If the H1B is not picked in the lottery, how to track the H1B Return packages?   The good news is that unlike previous years, USCIS is now sending a letter with the name of the beneficiary along with a receipt number for the file. Please see a sample from Vermont Service Center below.   Has anyone received a letter like this from H1B Employers? If you were advised that your H1B was not picked in...

The letters from USCIS are pouring in and some of the good news (you made it past the lottery) comes with bad news ... you have an RFE - Request for Further Evidence.  Do not panic.  This is not a denial. The biggest reason for RFEs was in last week’s blog - a job offer that does not match the education.  This is generally overcome with an evaluation that combines education with work experience in the field. Another common RFE is one that says your education is not government accredited.  Programs such as APTECH, which used to be accepted by USCIS...

As you are aware, USCIS has begun approving FY 2015 petitions during the first week of May 2014 and continue to approve both Premium and regular processing H1B Petitions. It is very surprising to note that H1B petitions that were filed under Regular Processing are being adjudicated with an approval or an RFE in such a short time. It is as quick as compared to the H1Bs filed under premium processing. I am very happy to hear from several H1B Employers and H1B aspirants that they have been getting Approvals as compared to RFEs, even the RFEs are not very complicated...

We understand your frustration when you get the news that your H1B is not picked in the lottery. But there is some hope and that hope may be applying to Canada for a Permanent Residence.    We all know over 100,000 H1B petitions are being returned by the USCIS. There is still some hope to become a Canadian Permanent Resident.  If your H1B is not picked in the lottery this year, applying to Canada under the FSW or QSW Program. The FSW Program is same as obtaining permanent residency in Canada.    What is the difference between FSW and QSW Programs? ...

We all know about the proposed regulation allowing H4s to work and “somewhat” good news for the H4 visa holders as announced by the Department of Homeland Security (DHS) to provide Employment Authorization for certain H4 visa holders. Although the rule is still in the making and awaiting public comments, if enacted certain H4 Visa holders will be eligible to apply for an EAD (Employment Authorization Document).    “Please note that all H4s will NOT be allowed to work”    In this article, I have attempted to explain the rule, eligibility and the H4-EAD application process (if rule is enacted) in...

On behalf of H1Bsupport.com, I would like to congratulate all of you, who got the H1B picked in the lottery and received H1B receipt notices. I feel very sorry for those who’s H1Bs were not picked in the lottery, please don’t be depressed, it’s not the END of the world. Your H1B filed under Premium Processing or Normal Processing, please note that the process will be the same for US Advanced degree H1B candidates and non US Advanced degree candidates. The only difference is the processing speed if it is Premium or Normal Processing. H1B petitions that were filed under the...

USCIS has concluded the H1B Lottery. USCIS announced today that data entry of all FY15 H-1B cap petitions has been completed. USCIS will now begin returning all H-1B cap petitions that were not selected in the lottery. U.S. businesses use the H-1B program to employ foreign workers in occupations that require highly specialized knowledge in fields such as science, engineering, and computer programming.   If you are an F1 OPT student and has not received an H1B receipt, it’s time to reinstate your F1 Status....
